The mother of a 10-year-old girl from Pennsylvania, who tragically lost her life after participating in a TikTok challenge, is permitted to proceed with her legal case against the social media platform, according to multiple reports.
Nylah Anderson, who died in December 2021, reportedly attempted the perilous “Blackout Challenge,” which involves self-asphyxiation.
Her mother, Tawainna Anderson, found her daughter hanging from a purse strap in their home, prompting a lawsuit against TikTok and its parent company, ByteDance.
The lawsuit alleges that the platform promotes dangerous challenges that entice children to engage in hazardous behaviors for the sake of user engagement and profit.
The claim asserts that TikTok has, for an extended period, intentionally promoted videos that are harmful to children through its algorithm, leading to an increase in child fatalities.
In October 2022, a federal judge dismissed the case, citing Section 230 of the Communications Decency Act, which protects content distributors from liability for third-party content.
However, the judge acknowledged the legitimacy of Anderson’s claims, allowing her to pursue legal action against TikTok regarding her daughter’s death.
The “Blackout Challenge” has been associated with the deaths of 20 children over an 18-month span, alongside other hazardous challenges like the “Skullbreaker Challenge” and the “Angel of Death Challenge,” which have also resulted in serious injuries and fatalities, according to reports on Independent news.
