The recent clash between Rep. Jasmine Crockett and GOP lawmakers has reignited controversy surrounding Melania Trump’s EB-1 visa – online often dubbed the “Einstein visa.”

Crockett questioned how the former First Lady, who was then an up-and-coming fashion model, obtained a visa intended for individuals with “extraordinary ability” in fields such as science, education, or athletics.

While Melania reportedly met the minimum legal threshold – satisfying three of the ten required criteria, including media coverage and high earnings – critics argue that this misses the broader point.

Under Trump’s administration, immigration policy tightened dramatically.

Researchers, professors, and even NBA prospects from banned nations were denied entry or deported, despite meeting far more rigorous academic and professional standards.

Many funded their own studies, played by the rules, and still were turned away.

Meanwhile, Melania’s path faced no such scrutiny – from the same administration that aggressively pushed a “merit-based” agenda.

That’s the hypocrisy Crockett is calling out.

It’s not about diminishing modeling – it’s about the glaring imbalance in how “merit” is measured and who immigration laws actually reward.

A 2025 CNN investigation for example, found that even J-1 and student visa holders at elite schools like Harvard and Tufts were told to “self-deport,” despite financial independence and legal documentation.

Supporters defend Melania, citing USCIS rules that allow applicants to qualify by meeting 3 of the following 10 criteria:

Major national or international prizes

Membership in elite professional associations

Media coverage in prominent outlets

Judging others in the field

Original contributions of major significance

Authorship of scholarly work

Artistic exhibitions or showcases

Leading role in major organizations

High earnings compared to peers

Commercial success in the arts

Melania’s team says she qualified based on media exposure, modeling income, and commercial visibility. But for many, the optics remain troubling.

At the end of the day, this debate isn’t just about visas, it’s about justice, consistency, and a hard truth: in a nation built by immigrants, who gets welcomed and who gets walled out remains a deeply political question.
