Forced to Detransition: Trans Prisoners Sue Georgia Over Controversial New Law.

In Georgia, a group of incarcerated transgender individuals has filed a lawsuit against the state for forcing them to “detransition”, meaning they are being denied access to gender-affirming medical care such as hormone therapy and surgeries.

Many of these individuals had already begun transitioning before or during their time in prison.

The lawsuit challenges Senate Bill 185 (SB 185), a controversial law that bans the use of state funds for treatments related to gender dysphoria, even when medically necessary.

The plaintiffs argue that this violates the Eighth Amendment, which prohibits cruel and unusual punishment.

Forcing someone to halt treatment can lead to severe mental and physical health consequences.

Essentially, the law compels trans inmates to revert to their birth-assigned gender, disregarding their identity and medical history.

Governor Brian Kemp signed SB 185 into law in May 2025, reinforcing the state’s stance against funding gender-affirming care for incarcerated individuals.
