Alina Habba, once Donald Trump’s personal attorney, has again been ruled unlawfully serving as U.S. Attorney for New Jersey. Her 120-day interim appointment expired in July 2025, and federal judges declined to extend her tenure.
Despite this, the Trump administration reinstalled her using a legal loophole, naming her acting U.S. attorney without Senate confirmation.
On August 21, Judge Matthew Brann struck down this maneuver, declaring Habba lacked legal authority since July 1 and disqualifying her from overseeing federal prosecutions.
The ruling followed challenges from defendants who argued any cases she brought were invalid.
Brann emphasized that the president cannot override judicial authority—a direct rebuke to Habba’s claim that judges should “respect the president”.
Habba responded defiantly, appearing on Fox News to criticize “rogue judges” and insisting the executive branch retains control over appointments.
Legal experts warn this standoff undermines judicial independence and risks politicizing federal law enforcement.
The Justice Department plans to appeal, but for now, Habba’s authority is void, and her continued presence in office remains a flashpoint in the battle over constitutional boundaries.
